Simply Giving Terms of Use
Representation
Simply Giving (ABN 56 114 321 327) supplies charities with the Simply Giving Website Facility & Service. Products that are purchased on the website are purchased from Simply Giving and not from the charity. At the end of the appeal, Simply Giving will supply and bulk-deliver all purchased products to the charity. Simply Giving is independent of the charity, does not represent the charity and does not act as an agent of the charity. Simply Giving is not a registered charity.
Accepted Payment Methods
Simply Giving only accepts VISA, Mastercard, Bank Card, American Express and PayPal.
Credit Card Security
All credit card transactions on Simply Giving are processed through a PayPal VeriSign payment gateway. All transaction processing is secured by 128-bit SSL encryption, plus PayPal meets the exacting standards of the major card associations, including SAS, PCI, and SDP. Receipt of Purchase
Simply Giving will email a Tax Invoice to all customers that purchase products on the website. The Tax Invoice will include Simply Giving's ABN, a unique identification number, a summary of the products purchased and the GST component of the total amount. The Tax Invoice is your proof of purchase.
Donation Confirmation & Tax Deductibility
Simply Giving will also email a Donation Confirmation to all customers that purchase products on the website. This confirms that your purchase has been donated to the charity. Donations of products may give rise to tax deductions in certain circumstances. You may wish to obtain tax advice in this regard.
Delivery of Products
At the end of the charity's appeal, Simply Giving will supply and bulk-deliver all purchased products to the charity.
Product Substitution
In the unlikley event that products become unavailable, Simply Giving reserves the right to substitute purchased products for similar products of the same value.
Cash Donations
Simply Giving will charge the charity 9% of cash donations. At the end of the charity's appeal, Simply Giving will transfer donated funds to the charity.
Giving Tree
The first $50 worth of donations per tree will be used to offset costs associated with the tree, including manufacture, handling and freight.
GST
All product prices quoted on Simply Giving include GST unless otherwise stated.
Product Pricing
Simply Giving always seeks to list products with the most competitive prices. Simply Giving reserves the right to change prices for products at any time.
No Refunds
Payments to Simply Giving are non-refundable.
Credit Card Fraud
Whilst Simply Giving employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Simply Giving will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
Liability
Simply Giving will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Other
If any provision of these Terms of Use is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms of Use and the remainder of the provisions in question shall not be affected thereby.
Simply Giving reserves the right to change the Terms of Use at any time.
No Simply Giving employee or agent has the authority to vary any of the Terms of Use.
